What are cookies?

What types of cookies are there?
Depending on the entity that manages them, cookies can be:
- Own cookies: These are sent to the user's terminal equipment from a computer or domain managed by the website owner from which the service requested by the user is provided. Depending on their intended purpose, cookies can be classified into the following types:

They also include those that allow a website to be personalised. These are exempt from complying with Article 22.2 of the LSSICE.
- Preference or personalisation cookies: These allow the user to access the service with some general characteristics predefined according to a series of criteria in the user's terminal, such as language, the type of browser through which the service is accessed, the regional configuration from which the service is accessed, etc. If it is the user himself who chooses these characteristics (for example, if he selects the language of a website by clicking on the icon of the corresponding country flag), the cookies are exempt from complying with Article 22.2 LSSICE.
- Analysis or measurement cookies: these allow the party responsible for them to monitor and analyse the behaviour of users of the websites to which they are linked, including the quantification of quantifying the impact of advertisements.
- Behavioural advertising cookies: these store information on user behaviour obtained through continuous observation of their browsing habits, allowing a specific profile to be developed in order to display advertising based on that profile.

What is the legal basis for the use of cookies on our website?

Legal Framework of Reference
The legal framework for the use of cookies in Spain is defined by Law 34/2002 on Information Society Services and Electronic Commerce (LSSI), as well as by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation) and the Organic Law on Data Protection and Guarantee of Digital Rights (LOPDGDD, Law 3/2018 of 5 December). With regard to the use of cookies, the second paragraph of Article 22 of the LSSI establishes the following:
“2. Service providers may use data storage and retrieval devices on recipients' terminal equipment, provided that the recipients have given their consent after having been provided with clear and comprehensive information about their use, in particular, about the purposes of the data processing, in accordance with the provisions of Organic Law 15/1999, of 13 December, on the Protection of Personal Data.
When technically possible and effective, the consent of the recipient to accept the processing of the data may be provided through the use of appropriate settings in the browser or other applications, provided that the recipient has to configure them during their installation or update through an express action for that purpose.
The foregoing shall not prevent the possible storage or access of a technical nature for the sole purpose of carrying out the transmission of a communication over an electronic communications network or, to the extent strictly necessary, for the provision of an information society service expressly requested by the recipient”
The GDPR mentions cookies in recital 30, which precedes the articles of the GDPR:
“(30): Natural persons may be associated with online identifiers provided by their devices, applications, tools and protocols, such as internet protocol addresses, session identifiers in the form of cookies or other identifiers, such as radio frequency identification tags. This may leave traces which, in particular, when combined with unique identifiers and other data received by servers, can be used to create profiles of natural persons and identify them.”
Thus, when cookies can identify an individual, they are considered personal data, just like an IP address. The LOPD establishes in Article 6.1, regarding consent for the processing of personal data:
“1. In accordance with the provisions of Article 4.11 of Regulation (EU) 2016/679, consent of the data subject shall mean any freely given, specific, informed and unambiguous expression of will by which the data subject agrees, either by a statement or by a clear affirmative action, to the processing of personal data concerning him or her.”
